The following terms and conditions ("Terms") govern the use of the Kiwbot website and all contents, services, and products accessible through it, including, among others, API services and functionalities offered by Kiwbot (collectively, our "Services"). The use of our Services is conditioned on the full and unmodified acceptance of these Terms, as well as all policies and procedures that Kiwbot may occasionally publish, including the Privacy Policy (collectively, the "Agreement"). Likewise, automatic updates of the Services will be subject to these Terms.

Please carefully read this Agreement before accessing or using our Services. By using any part of the Services, you confirm your acceptance of the Terms. If you do not agree with any part of this Agreement, you may not access or use the Services. The acceptance of this Agreement is expressly limited to these Terms.

To access our Services, you must create a Kiwbot account. It is your responsibility to provide accurate and complete information during registration.

If you use Kiwbot Services, the following conditions apply:

• Data Scanning and Analysis: We may analyze your data and content to generate anonymous or aggregated statistics to optimize the performance and security of our Services.
• Data Access:In the event that you lose access to your account or cancel your subscription, you will not be able to recover your data after 14 days of account inactivity.
• Data Ownership and Use:You retain ownership of your data. You grant us a global, royalty-free, non-exclusive license to copy and store your data solely for the purpose of operating our Services.
• Data Archiving: Inactive data will be archived after 21 days of inactivity. Accounts are considered inactive if:
  • Subscription invoices are not up to date.
  • There is no activity after multiple email notifications.

• Automatic Renewals: Subscriptions are automatically renewed unless canceled before the end of the billing period.
• Upgrades and Downgrades: Upgrades are charged immediately, while downgrades are applied immediately and any remaining credit will be applied to future invoices.
• Payment Failures: In the event of payment failures, Kiwbot may cancel your subscription without prior notice.
• Fee Changes: We reserve the right to modify fees by notifying you in advance. If you do not agree, you may cancel your subscription.

• Return Guarantee: We offer a 14-day refund guarantee. Outside this period, refunds are at the discretion of our support team.
• Chargeback Fraud: Kiwbot will legally pursue any attempt of fraud related to unauthorized chargebacks.

By using Kiwbot, you agree not to:

• Violate applicable laws
• Share inappropriate, discriminatory, or threatening content.
• Distribute malicious software or perform network attacks.

Technical support is provided through our specialized team, ensuring an initial response within 24 hours.

You are responsible for maintaining the confidentiality of your credentials. Immediately report any unauthorized use of your account or API.

By creating an account in our Service, you agree to subscribe to newsletters, marketing or promotional materials, and other information we may send you. However, you may opt out of receiving any or all of these communications by following the unsubscribe link or sending an email to info@kiwbot.com.

Our Services are designed for users over 13 years old (or 16 in the EU). Access by minors is strictly prohibited.

Kiwbot and B holik LLC do not guarantee continuous availability of the Services and will not be responsible for indirect damages, data loss, or service interruptions.

All disputes will be resolved under the jurisdiction of the state of New Mexico, USA.

We may use external service providers to monitor and analyze the use of our Service.

Google Analytics is a web analytics service offered by Google that tracks and reports website traffic. Google uses the collected data to track and monitor the use of our Service. This data is shared with other Google services. Google may use the collected data to contextualize and personalize ads in its own advertising network.
